End User Agreement
This end user agreement is a binding and legal contract between SOHO Internet Consulting who operate the web site "Whirlwind Traffic" (whirlwindtraffic.com) and you, the member. By completing the online membership application for Whirlwind Traffic you agree to abide by this end user agreement.
The Service
Whirlwind Traffic is a service that permits its members to view web pages, banner advertisements and text link advertisements from other members. Whilst viewing advertisements, the member is credited so that their web advertisements may be viewed by other members.
Members are permitted to submit their advertisements (web sites, banner ads, text ads) for approval by the administrator. The following types of advertisements and material are not permitted:
- Websites that include or promote adult themes(pornography)
- Websites that promote hate, racist or otherwise morally objectionable material
- Websites that promote tobacco products, alcohol, illegal or illicit subjects or activities (including spam, ponzis, pyramid schemes etc)
- All manner of pay to promote (PTP) sites are strictly forbidden
- Any website that we deem to be inappropriate, disruptive or potentially harmful to our members and their use of the Whirlwind Traffic web site
- High yield investment programs or any similar program that makes ridiculous earning claims
You are permitted to promote your websites that have no more than 1 popup window. Your website should not in any way promote, encourage or facilitate the sending of unsolicited commercial email.
You are not permitted to send any email at any time which states or suggests that you represent Whirlwind Traffic, the service or its employees.
You are permitted to promote the service on your website so long as you use the existing promotional materials that are provided to you in our member area.
Your advertisements must not, in any way, disrupt the normal operation of the service.
We do not tolerate unsolicited commercial email (spam) in any form. If you are found to be sending spam with reference to Whirlwind Traffic your account may be terminated.
Guarantees
Whilst all due care will be taken to ensure continuity of service and the provision of accurate customer information, we provide no guarantee of accuracy or that the service will be available at all times.
Indemnity
You agree to indemnify Whirlwind Traffic and SOHO Internet Consulting against any and all actions or consequences arising from your use and/or misuse of the service.
Termination
You agree that SOHO Internet Consulting may terminate your member account at any time if it is believed that you are in breach of these terms. You have the right to appeal any decision but the final decision will rest solely with SOHO Internet Consulting. If you are found to be in breach of our terms and conditions your member account may be terminated without notice and any fees paid to SOHO Internet Consulting and it's partners will be forfeit.
SOHO Internet Consulting reserves the right to alter these terms and conditions at any time it sees fit. In the case of any major alteration which may adversely affect existing clients, a notice detailing the changes will be sent to all members. Any minor changes will be noted on the main page of the Whirlwind Traffic web site.
Refunds
As our product is not a physical product and is delivered to you immediately we generally do not offer a refund on purchases of credits or upgraded membership. We may make exceptions in situations of personal hardship or extraordinary circumstances.
